Sales and Distribution

1. Acceptance and Billing
Before accepting an order, we may request additional information from you, and we reserve the right to reject orders or to cancel them after acceptance. By confirming your purchase during the checkout process, you agree to accept and pay for the order. To be eligible to complete an order, you must be at least 18 years of age or older.

2. Pricing and Sales Tax
All prices are in U.S. dollars. All prices posted on this site are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed. Posted prices do not include taxes or charges for shipping and handling. We are not responsible for pricing, typographical, or other errors in any offer by us and we reserve the right to cancel any orders arising from such errors. Sales tax is charged on orders where applicable. The sales tax will be based on the state the order is being shipped to. Please note that some states charge sales tax on shipping fees as well.

3. Purchasing
If you wish to purchase any product made available through our website, you may be asked to supply certain information relevant to your purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
We accept payment methods as provided during the checkout process. We are not responsible for external payment processor practices or their terms. By placing an order, you represent and warrant that the payment information you supply to us is accurate, you are duly authorized to use the designated payment method, and that you authorize us, or our payment processor, to charge your designated payment method.
We reserve the right to automatically suspend or cancel your order if we cannot verify the payment method you designate, or if it is invalid or otherwise not acceptable. Only valid payment methods specified by us may be used. You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any purchase; and that (ii) the information you supply to us is true, correct and complete. You expressly agree that Underground Leather and Squarespace are not responsible for any loss or damage arising from the submission of false or inaccurate information.

4. Retail, Distributing and Reselling
Businesses and companies may not distribute, resell or stock any Underground Leather products, unless specifically authorized under contract by Underground Leather to do so. These restrictions do not apply to individual customers of Underground Leather who choose to resell used products, so long as the asking price does not exceed the original purchasing price, otherwise known as “scalping”.

5. Shipping and fulfillment
To keep track of shipments and deliveries, check emails we send you, including your spam folder. We may request additional information through email or other contact forms to process your order.
Underground Leather shall be under no liability for any delay or failure to deliver products or otherwise meet any obligation put forth here if the delay or failure is in full or in part caused by circumstances beyond our reasonable control unless otherwise prohibited by law. All orders are shipped with tracking and mailing insurance, and are made pursuant to a shipment contract. This means that the risk of loss for such items pass to you once your item is accepted by the shipping carrier. Orders that arrive damaged or are lost in transit must be handled by the customer through the appropriate mail carrier.

6. Shipping and Delivery Times.

Everything in the ready to ship section ships within 1-3 days of purchase.

Everything in the made to order section has a production time listed at the bottom of the item. On average, that’s 2-3 weeks for small items, and 4-6 weeks for large items. This does not include shipping time.

Custom orders can take up to 8-12 weeks depending on the complexity of the item.

Once the order has shipped, how quickly it is delivered depends on the shipping provider. Estimated delivery dates to your zip code are provided at checkout and updated via email once your order is ready to ship. Please keep in mind they are estimates only, we do not guarantee the delivery date. We ship Orders Monday through Friday excluding holidays. Our carriers may or may not require a signature based on the shipping method you selected.

7. International Delivery
You can expect the same production time as domestic orders. Buyer is responsible for customs or VAT.

8. Cancellations
To the fullest extent permitted by applicable law, we may refuse or cancel an order for any reason including limitations on the quantity available, eligibility requirements, inaccuracies or errors in pricing information, or problems identified by our credit and fraud avoidance partners. We are not responsible for pricing, typographical, or other errors and we reserve the right to cancel any orders arising from such errors, even after your receipt of an order confirmation. If your Order is canceled after your credit card (or other payment account) has been charged, we will issue a credit to your credit card (or other applicable payment account) in the amount of the charge.

9. Returns and Exchanges

Due to the nature of our products, we cannot accept returns, as they are considered intimate products. Orders that arrive damaged or are lost in transit must be handled by the customer through the appropriate mail carrier.

We do offer a one-time modification to wearable items. Buyer is responsible for shipping costs unless we made an error on our end with sizing.
